Court slams Flipkart for defective goods, orders refund

A consumer court in Mumbai has strongly reprimanded Flipkart for delivering defective goods to a customer and refusing to accept the return based on a no-return policy.

A consumer court in Mumbai has strongly reprimanded Flipkart for delivering defective goods to a customer and refusing to accept the return based on a no-return policy. The court ruled that this was an unfair business practice and ordered Flipkart to refund the customer's money with interest, along with an additional Rs 10,000 to cover legal costs.

The case involved Taruna Rajput, a resident of Goregaon, who had ordered 13 containers of Herbalife Nutrition Fresh Energy Drink Mix from Flipkart on October 9, worth Rs 4,641. Upon receiving the products, she found discrepancies such as the absence of QR codes on the labels and a noticeable difference in taste and color of the drink mix. Upon discovering the substandard goods, Rajput contacted Flipkart customer care to request a return, but her request was denied due to the company's no-return policy for the product.

Dissatisfied with the company's response, Rajput approached the consumer forum, providing evidence of her correspondence with Flipkart. After reviewing the case, the court sided with Rajput, ruling that Flipkart's refusal to take back the defective goods was a breach of service and an unfair business practice.

The court ordered Flipkart to refund the full amount paid by Rajput, along with 9 percent interest, and additionally awarded her Rs 10,000 as legal costs. However, her request for Rs 50 lakh in compensation for the loss suffered was dismissed by the court.
